Terms of Service

1. Eligibility

You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older and able to enter into this agreement. Selling through the marketplace is currently available to users in the United States only.

2. Your account

You are responsible for keeping your login secure and for all activity under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use. You may delete your account at any time by contacting us.

3. Subscriptions, billing, and refunds

• Free trial: new accounts may receive a free trial of the core app. Certain features, including the buy/sell marketplace, are available to paid subscribers only.
• Pricing and renewal: paid plans are billed through Stripe on a recurring basis (monthly or annual) at the price shown at checkout. Your subscription renews automatically at the end of each period until you cancel.
• Cancellation: you can cancel anytime through the billing portal in the app. Cancellation stops future renewals. Your paid features remain active until the end of the period you have already paid for.
• Refunds: payments are generally non-refundable. We review refund requests on a case-by-case basis and may grant them at our discretion. Contact us to make a request.
• Price changes: we may change subscription prices. Any change applies to future billing periods, and we will give you reasonable advance notice. Continuing your subscription after a price change means you accept the new price.

4. Your content

You keep ownership of the content you add, such as your collection data, notes, photos, and listings ("Your Content"). You grant us a limited license to store, display, and process Your Content only as needed to operate the Service for you and, where you choose, to share it with your friends or show your listings to other users. You are responsible for Your Content and confirm you have the right to upload it. Do not upload content that is unlawful, infringing, or that you do not have the right to share.

5. Marketplace

The Service lets users list items and connect with one another to buy and sell. Please understand:

• We provide a venue only. We are not a party to any transaction between users, and we do not process payments between buyers and sellers.
• Buyers and sellers are solely responsible for their transactions, including payment, shipping, item condition, returns, and any applicable taxes.
• We do not guarantee the quality, safety, legality, or accuracy of any listing, or that a buyer or seller will complete a transaction.
• You agree to list only items you own and are legally allowed to sell, and to deal with other users honestly and lawfully.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose.
• Harass, threaten, or abuse other users.
• Post false, misleading, infringing, or inappropriate content.
• Attempt to access other users' accounts or data, or interfere with or disrupt the Service.
• Scrape, copy, or resell the Service or its catalog except as allowed by law.

We may suspend or remove content or accounts that violate these Terms.

7. Intellectual property and brand names

The Service, including its software, design, and original content, is owned by us and protected by law. The Little Tracker is an independent tool and is not affiliated with, endorsed by, or sponsored by Little Sleepies or any clothing brand. Product names and images in the catalog are the property of their respective owners and are used only to help you identify items in your own collection.

8. Third-party services

The Service relies on third parties such as Stripe (payments), Supabase (accounts and data), Vercel (hosting), and Resend (email). Your use of features that involve these providers may also be subject to their terms.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that your data will always be available. You are responsible for keeping your own copies of information that is important to you.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service or from any transaction between users. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or twenty US dollars.

11. Indemnification

You agree to indemnify and hold us harmless from claims, losses, and expenses arising out of your use of the Service, Your Content, your transactions with other users, or your violation of these Terms.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you in the app or by email. Continuing to use the Service after changes means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of South Carolina, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in South Carolina, and you consent to their jurisdiction.
